1. BACKGROUND INFORMATION

These general terms and conditions (“general terms”) apply to you as a consumer (“customer”) when you place an order via the address www.aquaction.fi. The general terms and conditions apply only to consumer customers.

1.2
The customer must be at least 18 years of age to place an order through the website. Aquaction reserves the right to reject or change the customer's order (e.g. if the customer has provided incorrect personal information and/or has a record in their credit report).

1.3
Aquaction is not liable for compensation if the products are sold out or if the website contains graphic or typographical errors (e.g. errors in product descriptions or technical data), incorrect prices and price adjustments (such as prices changed by suppliers and currency changes) or incorrect information about the product's stock status. Aquaction has the right to correct any such errors and to change or update the information at any time. If an incorrect price has been stated for a product ordered by the customer, Aquaction will naturally inform the customer and wait for the customer to accept the corrected price before Aquaction continues the ordering process.

2. AGREEMENTS AND ORDERS

The customer must accept the general terms and conditions in order to place an order through the website. By accepting the general terms and conditions, the customer agrees to comply with the general terms and conditions in their entirety and confirms that they have read the information.

A purchase agreement is concluded when Aquaction has confirmed the customer's order and the customer has received the order confirmation by email. From Aquaction .

3. CUSTOMER INFORMATION

The customer confirms that the information provided is correct and complete and is responsible for any errors in the information provided. The Customer undertakes to ensure that no one other than the Customer himself/herself uses the Customer's login information. The Customer may not disclose his/her username or password to anyone and ensures that all documents containing information regarding the username and password are stored in a way that is not accessible to unauthorized persons. The Customer declares Aquaction immediately if he suspects that an unauthorized person has access to the customer's password. The customer is responsible for all purchases made with his login information if the customer has not made the above notification.

3.3
If Aquaction suspects that the customer is misusing their user account or login information or is otherwise violating the general terms and conditions, Aquaction has the right to block the customer's access to their user account. In addition Aquaction has the right to assign new login information to the customer.

4. PRICES, COSTS AND PAYMENT

The prices stated on the website apply only to orders placed on the website. All prices are stated in euros and include VAT. Prices do not include payment and delivery costs, which are stated separately.

5. SPECIAL OFFERS

All offers on specific products on the website are valid for a limited time only or until the products are sold out.

6. DELIVERY AND TRANSPORTATION

6.1
Products in stock are usually delivered within the business days stated on the website . Unless otherwise agreed (e.g. when ordering products that are not in stock), delivery will take place within 30 business days from the date of order. Aquaction has confirmed the order in writing using an order confirmation.

6.2
The estimated delivery time is stated in the order confirmation, at checkout and/or on the website on the relevant product page. Unless otherwise expressly agreed, and if delivery is delayed for more than 30 business days for reasons beyond the customer's control, you have the right to cancel your purchase.

6.3
If the package is to be picked up at a specific delivery location, the customer will pick it up within the time specified in the notification. Packages are usually picked up in person, using a valid ID and order number. The customer will receive a notification of delivery, specifying when and where the package can be picked up or received. The notification may be sent by email, regular mail and, if the customer has provided their mobile phone number, also by phone or text message. If the package is not picked up, Aquaction has the right to charge the customer for the costs incurred, amounting to €14.95.

7. RIGHT OF CANCELLATION

7.1
When a customer purchases products from the website, they have a 14-day cooling-off period under applicable consumer law. This means that the customer has the right to cancel any purchase by notifying To Aquaction within 14 days from the date on which the customer or their representative has received the ordered product (cancellation period).

7.2
The right of withdrawal does not apply to the following products:

(a)
products that are manufactured according to customer specifications or otherwise clearly identified.

(b)
Products with broken seals may not be returned for health or hygiene reasons.

(c)
products that spoil or expire quickly.

7.3
By accepting these general terms and conditions, the customer understands and accepts that the right of cancellation does not apply in the above cases.

7.4
If a customer orders a product that is not covered by the right of cancellation, the customer will be clearly informed of this.

7.5
If the customer wants to cancel the purchase, the customer must send a clear message before the cancellation period expires. Aquaction . In the message, the customer must provide their name, address and other relevant information, such as the order reference, invoice number and product name. If the customer does not wish to use the above alternative message, they can use the standard form on the right of withdrawal of the national Competition and Consumer Authority (see link on the website http://www.kkv.fi/)

7.6
If the customer exercises their right of withdrawal, they will pay the return costs and are responsible for the condition of the product after receiving it and during return transport. The product must be returned within 14 days of Aquaction was notified of the cancellation. The product must be sent well packaged, in good condition and in its original box and/or packaging.

7.7
Aquaction may offer free returns on certain products at any time. If free returns are available, this will be announced on the website, on the relevant product page.

7.8
When a customer cancels their purchase, Aquaction will refund the amount the customer paid for the product, including shipping costs. Returns will be subject to a handling fee of €4.95.


7.9
Aquaction will repay the amount without undue delay, but no later than 14 days from the date on which Aquaction received the product. The refund will be made to the customer using the payment method chosen by the customer, unless otherwise agreed or if there is any obstacle to such a refund.

8. WARRANTIES AND COMPLAINTS

8.1
In certain Aquaction products may be covered by a warranty. Product warranties only cover manufacturing defects and do not cover any defects resulting from any individual change in the function or appearance of the product. The customer's order confirmation serves as proof of warranty.

8.2
The right of appeal applies to products that are defective in accordance with applicable consumer protection legislation. A customer who wishes to exercise their right of appeal regarding a product must take Contact Aquaction as soon as possible after discovering the defect, using the contact details provided on the website. Complaints made by the customer within two months after discovering the defect are always considered to have been made in due time. The customer has the right to make a complaint about products purchased from the website within a reasonable time after receiving the product.

8.3
Aquaction is responsible for the shipping costs of all returns resulting from approved complaints.

8.4
Regarding complaints Aquaction follows the instructions issued by the Consumer Disputes Board (see www.kuluttajariita.fi).

9. LINKS

Aquaction may provide links to other websites that are not Under the control of Aquaction . Also websites that are not under the control of Aquaction , may provide links to the Website. Although Aquaction strives to ensure that Aquaction only provides links to websites that comply with Personal data and security regulations that are consistent with Aquaction's privacy policy, Aquaction is not responsible for the security or confidentiality of any information or personal data that the customer provides on other websites. The customer must be careful and read the personal data provisions that are followed on that website.

10. OVERWHELMING OBSTACLE

Aquaction is not responsible for any delays or cancellations of orders caused by circumstances beyond its control. Aquaction cannot influence. These include, for example, general industrial disputes, military operations, fires, lightning strikes, terrorist attacks, changes in official regulations, technical problems, faults in power/telephone/computer connections or other communications, as well as faults and delays in services provided by subcontractors, which are due to the above-mentioned circumstances. In such situations, the obligation to pay damages and other measures shall lapse. If such a situation occurs, Aquaction will notify the customer both at the beginning and at the end of the situation. If the situation has lasted for more than two months, both the customer and Aquaction has the right to suspend the purchase with immediate effect.

11. CHANGES TO THE GENERAL TERMS AND CONDITIONS

Aquaction reserves the right to change these general terms and conditions at any time. Any changes to these general terms and conditions will be published on the website. The changes will become effective when the customer has accepted the general terms and conditions (in connection with a new purchase or when browsing the website).

12. APPLICABLE LAW AND DISPUTE RESOLUTION

12.1
In cases of disagreement, Aquaction will comply with the decisions of the Finnish National Consumer Disputes Board or similar authorities in other European countries.

12.2
All disputes concerning the interpretation or application of these general terms and conditions are subject to and interpreted by Finnish law, and will ultimately be resolved by the courts of Finland.
